State Programmatic General Permit (SPGP) Update:
Final 2017 SPGP Released

On June 29, 2017, the Norfolk District of the U.S. Army Corps of Engineers (COE) announced the issuance of the 2017 State Program General Permit (17-SPGP-01), effective immediately.  This permit supersedes and replaces all previous versions.  The final 17-SPGP-01 did not include major changes since the draft 17-SPGP-01 was released on April 13, 2017.  For a refresher on what has changed from the previous 12-SPGP-01, please see our April 18, 2017 Field Notes.

Note that processing and coordination of new 17-SPGP-01 applications will not commence until the Virginia Marine Resources Commission (VMRC) assigns and project number and DEQ has confirmed the application package is complete.  The COE issued a “17-SPGP-01 Complete Application Checklist” as an attachment to their Standard Operating Procedures.  For additional information on the 17-SPGP-01, including the COE’s justification for not making any major changes to the draft version, please refer to the Decision Document.  For more information regarding the 17-SPGP-01 and related documents, please visit our webpage.

If you previously submitted a 17-SPGP-01 Reverification request, The Virginia Department of Environmental Quality (DEQ) confirmed inter-agency coordination has now been initiated with the final issuance of the 17-SPGP-01.  Due to required coordination timeframes, it will likely be several weeks before the first reverification requests are formally approved.  

If your project was authorized by a 12-SPGP-01, and you were under construction or under contract to construct by May 31, 2017, the project will remain authorized under the existing permit until May 31, 2018.  If you need to continue work in the authorized impact areas beyond May 31, 2018, you will need to apply for reverification under the 17-SPGP-01.
